1. INTRODUCTION

1.1 These are the legal terms and conditions (“Terms”, “Subscription Terms”), which apply to the services available from https://wpfiddlybits.com (“our website”, “we”, “our”, “us”) and to any correspondence by email between you and us. Please read these terms carefully before using our website. If you do not agree to these terms you are not authorised to use our services.

1.3 When you order services from https://wpfiddlybits.com, you agree to all of these Terms.

1.4 Please read the following Terms carefully as they form an agreement between us.

1.5 Please understand that if you refuse to accept these terms and conditions, you will not be able to order any Services from our site.

2. DETAILS OF SERVICES OFFERED

WPFiddlyBits.com is an online service that offers chat and email support to operators of websites running on single-site installations of WordPress. Our website describes the Services in more detail.

Services are available only to legal entities and to individuals who are at least 18 years old.

Support must be requested through the proper channels to be received and responded to in a reasonable amount of time. To request support please email [email protected].

Each request is subject to a maximum of one hour support [Premium Plan] and two hours support [Professional Plan] per month. No support requests are offered to subscribers of the Basic Plan. The effort required for development is exclusively determined by the WP Fiddly Bits management. For work outside of the scope of the WP Fiddly Bits support agreement, WP Fiddly Bits management may provide alternative solutions to the client including hiring extra development hours from WP Fiddly Bits or referral to the WP Fiddly Bits partner network.

WP Fiddly Bits provides no guarantee either express or implied on the timeframe of when a support request can or will be resolved.

Your requests are subject to approval by WP Fiddly Bits management or by its assigned agent.

Requests should fall within the following categories.

UI troubleshooting (HTML, CSS, Javascript)
Styling elements with CSS
Optimization of CSS, Javascript and Images
Theme or plugin audits
Plugin installation and implementation
Content population and image manipulation e.g. resizing
Creation of basic graphics (e.g. buttons, banners, etc.)
WordPress consulting (advice and support)

If you are unsure about the whether or not a request meets these criteria, submit it as a ticket to our support system at [email protected] and we will either accept the ticket or deny the ticket based on managerial approval.

Examples of requests which shall not meet WP Fiddly Bits management approval for support:

Website redesigns

Landing page or Squeeze page design

Custom WordPress plugin development

WordPress custom theme development

Search engine marketing or SEO services

Any fixes deemed by WP Fiddly Bits management to exceed the time allocated in your Plan.

However, you may request these services as a one off project for which we will provide a quotation for and ask for your agreement prior to commencement of work.

3. PAYMENT

3.1 We will commence supplying our services to you as soon as you accept these Terms. Unless you and Babylonian Associates Ltd agree otherwise, you will not be able to cancel these Terms under the Consumer Protection (Distance Selling) Regulations 2000 or any equivalent legislation in your jurisdiction once the supply of the services has been commenced.

3.2 Each subscription is subject to a fee which is provided on our website.

3.3 Each subscription is for a single website only.

3.4 Responsibility for the security of any passwords issued by us rests with you.

3.5 We make every effort to ensure that the pricing on our website is correct. However, if an error in pricing is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable).

3.6 We reserve the right to alter all pricing without notice.

3.7 Unless otherwise stated, all fees are payable in GBP pounds sterling. You are responsible for paying all fees and application taxes associated when using our website in a timely manner with a valid payment method.

3.8 When you place an order you will automatically receive a confirmation email to confirm your order, provided you have supplied your email address. Your order constitutes an offer made to us to purchase the services specified in the order.

3.9 We only accept your order once we have sent you a purchase confirmation email.

3.13 If you are ordering our services from outside the UK the recipient of the product is responsible for all applicable taxes or tariffs incurred at the bill to address from which the service is ordered. Please note we are unable to provide specific advice on custom duties, taxes or tariffs.

3.14 We cannot guarantee continuous or secure access to our services, and the operation of the website may be interfered with by numerous factors outside of our control. While will use our reasonable endeavours to maintain an uninterrupted service, we cannot guarantee this and we do not give any promises or warranties (whether expressed or implied) about the availability of our services.

3.15 We shall not be liable to you in contract, tort (including negligence) or otherwise for any business losses, such as loss of data, profits, revenue, business, opportunity, goodwill, reputation or business interruption or for any losses which are not reasonably foreseeable by us arising out of the use of our services.

3.16 We shall not be liable for delay or failure to perform any obligation under these Terms if the delay or failure is caused by any circumstances beyond our reasonable control, including but not limited to, acts of god, war, civil disorder or industrial disputes.

4. CANCELLATION POLICY

Please note that if you purchase services from us, the performance of our services will begin immediately after you have received our purchase confirmation email.

You are never required to stay with us and can cancel at any time by issuing a termination request.

WP Fiddly Bits require two working days to fulfil a termination request.

WP Fiddly Bits may terminate or suspend any and all Services immediately, without prior notice or liability, for any reason whatsoever, or for no reason, including without limitation if you breach the Terms. Upon termination of your account, your right to use the Services will immediately cease. If you wish to terminate your WP Fiddly Bits subscription, you must contact us with your termination request. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

As stated above notification of cancellation must be in writing to [email protected], a telephone call is not a valid cancellation.

6. GENERAL

6.1 We reserve the right to alter, suspend or discontinue any aspect of our website or the content or services available through it including your access to it. Unless explicitly stated, any new features including new content and/or the sale of new Products/ Services shall be subject to these terms and conditions.

6.2 These terms set out the entire agreement and understanding between you and WPfiddlybits.com

6.3 We reserve the right to change these Subscription Terms at any time, without giving notice to you.

6.4 Any formal legal notices should be sent to us at the address at the end of these Subscription Terms by email confirmed by post. Failure by us to enforce a right does not result in a waiver of such right.

6.5 Nothing in these Subscription Terms shall confer on any third party any benefit or the right to enforce any term of these Subscription Terms.

6.6 Nothing in these Subscription Terms affects your rights as a consumer.

7. SEVERABILITY

7.1 The foregoing paragraphs, sub-paragraphs and clauses of these Terms shall be read and construed independently of each other. Should any part of this agreement or its paragraphs or sub-paragraphs or clauses be found invalid it shall not affect the remaining paragraphs, sub-paragraphs and clauses.

8. APPLICABLE LAW

8.1 These Terms of Service are governed by English Law.

8.2 The Courts of England and Wales shall have exclusive jurisdiction over any claim arising from relating to, a visit to our website although we retain the right to bring proceedings against you for breach of these terms and conditions in your country of residence or any other relevant country.
